Update: UEA motion denied by court - February 13, 2006

In its motion for summary judgment, the UEA had asked the Court to determine (1) that the Duluth contract automatically applies to UMC faculty and (2) that the University is committing unfair labor practices by refusing to bargain on that basis. Last week, Judge Crump denied the UEA motion in its entirety. In a memorandum incorporated as part of his order, the Judge wrote: “As a matter of law, Defendant Board of Regents is not obligated to apply the terms of the existing collective bargaining agreement with the University of Minnesota-Duluth faculty to the University of Minnesota-Crookston faculty who voted in favor of joining the bargaining unit represented by Plaintiff UEA.”

The University and UMC are looking forward to meeting with representatives of UEA to continue negotiations. Meetings are scheduled to resume on Thursday this week.
